Afrihelps LLC, a Georgia limited liability company. These Terms of Service govern your access to and use of the Afrihelps website, mobile application, and related services (collectively, the “Marketplace”). By accessing or using the Marketplace, you (“User”) agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Marketplace.
1. Definitions
- “Afrihelps” means Afrihelps LLC, the operator of the Marketplace.
- “Marketplace” means the Afrihelps website, mobile application, and all related digital services.
- “Service Provider” means any individual or business offering services through the Marketplace.
- “Consumer” means any individual using the Marketplace to search for, contact, or engage Service Providers.
- “User” means any person accessing or using the Marketplace, including both Consumers and Service Providers.
2. Acceptance of terms
These Terms of Service ("Terms") govern access to and use of the Afrihelps website, mobile experience, and related services (together, the "Platform"), operated by Afrihelps LLC, a Georgia limited liability company ("Afrihelps," "we," "us," or "our").
By creating an account, submitting a service request, registering as a Provider, or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Platform.
3. About Afrihelps
Afrihelps is a culturally focused digital directory that connects Consumers with Service Providers. Afrihelps:
- Does not provide services
- Does not employ Service Providers
- Does not supervise or control Service Providers
- Is not a party to any agreements between Consumers and Service Providers
4. Eligibility and accounts
To use the Marketplace, Users must:
- Be at least 18 years old
- Provide accurate and truthful information
- Not impersonate any person or entity
- Comply with all applicable laws
5. Service Provider verification
5.1 Identity verification (government-issued ID only). Service Providers must submit a valid government-issued identification document (e.g., driver’s licence, passport, national ID) to confirm identity and reduce fraud. This verification only confirms identity. It does not confirm qualifications, skills, licensing, or background.
5.2 No background checks at this time. Afrihelps does not currently conduct:
- Criminal background checks
- Professional background checks
- Employment or education verification
- License or certification verification
- Any other form of comprehensive vetting
5.3 Reservation of rights
Afrihelps may introduce background checks or additional verification procedures in the future. If implemented, Users will receive advance notice, updated Terms will be posted, and continued use of the Marketplace will constitute acceptance.
5.4 Consumer responsibility. Consumers acknowledge that identity-only verification does not guarantee the safety, legitimacy, or qualifications of any Service Provider. Consumers must evaluate Service Providers independently.
6. Fees
6.1 No fees at this time. Afrihelps currently provides access to the Marketplace at no cost to Consumers and Service Providers.
6.2 Future fees. Afrihelps may introduce fees in the future, including subscription fees, listing fees, booking fees, convenience fees, premium feature fees, transaction fees, and other fees. Users will receive at least thirty (30) days’ notice before any fees take effect.
6.3 No guarantee of free access. Current free access does not guarantee free access in perpetuity.
7. User conduct
Users agree not to:
- Provide false or misleading information
- Engage in fraud, harassment, or abusive behaviour
- Post unlawful, harmful, or discriminatory content
- Attempt to circumvent identity verification
- Interfere with Marketplace operations
- Misuse Afrihelps branding or intellectual property
8. Service Provider responsibilities
Service Providers must:
- Provide accurate business information
- Comply with all licensing, regulatory, and legal requirements
- Deliver services in a professional manner
- Communicate honestly with Consumers
- Not misrepresent qualifications or capabilities
9. Consumer responsibilities
Consumers must:
- Evaluate Service Providers independently
- Exercise judgment and caution when engaging services
- Communicate respectfully and honestly
- Comply with all applicable laws
10. Relationship between Users and Afrihelps
10.1 No agency relationship. Afrihelps is not an agent, employer, or representative of any User.
10.2 No guarantees. Afrihelps does not guarantee the quality of services, the accuracy of listings, the availability of any Service Provider, or the outcome of any engagement.
11. Intellectual property
All Afrihelps trademarks, logos, content, and platform features are the exclusive property of Afrihelps LLC. Users may not copy, reproduce, or distribute any part of the Marketplace without written permission.
12. Privacy
Use of the Marketplace is subject to the Afrihelps Privacy Policy. By using the Marketplace, Users consent to the collection and use of information as described in the Privacy Policy.
13. Disclaimers
The Marketplace is provided “as is” and “as available.” Afrihelps disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy of listings, and safety of interactions. Afrihelps does not guarantee uninterrupted or error-free operation.
14. Limitation of liability
To the fullest extent permitted by law:
- Afrihelps is not liable for any damages arising from interactions between Consumers and Service Providers.
- Afrihelps is not liable for any injury, loss, fraud, misconduct, or disputes arising from services rendered.
- Afrihelps’ total liability shall not exceed $100 USD or the amount paid by the User in the past twelve (12) months, whichever is greater.
15. Indemnification
Users agree to indemnify and hold harmless Afrihelps from any claims, damages, losses, liabilities, or expenses arising from User content, User conduct, User interactions with other Users, or violations of these Terms.
16. Termination
Afrihelps may suspend or terminate access to the Marketplace at any time for violations of these Terms or for any reason deemed appropriate. Users may discontinue use at any time.
17. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
